Terms of Service

These Terms of Service (“Terms”) govern your use of Gratify, a creator tipping platform operated by Gratify Inc., a Washington State company (“Gratify,” “we,” “us,” or “our”). By creating an account or submitting a tip, you agree to be bound by these Terms. If you do not agree, please do not use the platform.

About Gratify
Gratify provides creators with a personalised tip page, a fan relationship manager (CRM), and recordkeeping tools designed to help creators track income eligible for the No Tax on Tips federal deduction. Gratify is not a bank, payment processor, or tax-advisory service.

Platform Fee
Gratify charges a 5% platform fee on each completed tip transaction. This fee is deducted automatically from the tip amount before funds are transferred to the creator. Stripe’s standard payment-processing fees apply separately and are not charged by Gratify.
Example: a $10 tip results in $9.50 transferred to the creator (before Stripe processing fees). Fee structures may be updated with 30 days’ notice to active creators.

Payment Processing via Stripe
All payments are processed by Stripe, Inc. By using Gratify you also agree to Stripe’s Terms of Service. Gratify does not store full card numbers, CVV codes, or other sensitive payment credentials — this data is handled exclusively by Stripe.
Creators who opt into direct payouts must connect a Stripe Express account and agree to Stripe’s Connected Account Agreement. Creators using platform payout receive funds distributed by Gratify on a weekly schedule.

Creator Responsibilities
- ✓Provide accurate account information, including a valid payout method.
- ✓Comply with all applicable laws, including income tax obligations arising from tips received.
- ✓Only accept tips for lawful purposes and in connection with legitimate creative work.
- ✓Maintain the accuracy of content on your tip page, including your name and bio.
- ✓Promptly notify Gratify of any unauthorised access to your account.
- ✓Not create multiple accounts to circumvent any platform limit or suspension.

Fan Responsibilities
- ✓You are at least 18 years old or have parental consent to use the platform.
- ✓You are authorised to use the payment method you provide.
- ✓Tips are voluntary gifts. They do not entitle you to goods, services, equity, or any financial return.
- ✓You will not use chargebacks or disputes fraudulently to reverse legitimate tips.
- ✓You will not use Gratify to harass, threaten, or harm creators.

NTOT Recordkeeping — Not Tax Advice
Gratify provides tools to track tip income for potential use in connection with the No Tax on Tips Act (NTOT), a federal tax provision covering tax years 2025–2028. These tools are designed for recordkeeping convenience only.
Nothing on Gratify constitutes legal, financial, or tax advice. Creators should consult a qualified tax professional to determine their individual eligibility for the NTOT deduction and ensure compliance with IRS requirements.

Prohibited Content & Conduct
You may not use Gratify to:
- ✓Solicit tips in connection with illegal goods, services, or activities.
- ✓Impersonate another person, creator, or organisation.
- ✓Post harmful, abusive, defamatory, or sexually explicit content.
- ✓Engage in or facilitate fraud, money laundering, or financial crimes.
- ✓Circumvent Stripe's Acceptable Use Policy or any applicable financial regulation.
- ✓Automate tip submissions, scrape user data, or abuse the platform's systems.
- ✓Offer guaranteed financial returns in exchange for tips (which would constitute an unregistered security).

Account Termination
Gratify reserves the right to suspend or permanently terminate any account that violates these Terms, at our sole discretion and without prior notice. We will make reasonable efforts to notify you of the reason for termination unless prohibited by law or the circumstances make it impractical.
Creators with pending payouts will receive any funds owed within 30 days of termination, after deducting any outstanding fees, chargebacks, or amounts owed to Gratify. You may also terminate your account at any time by contacting hello@gotgratify.com.

Disclaimers & Limitation of Liability
Gratify is provided “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted service, error-free operation, or that tips will always be processed successfully.
To the maximum extent permitted by law, Gratify’s liability to any user for any claim arising under these Terms shall not exceed the total fees paid by that user to Gratify in the 90 days preceding the claim.

Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict-of-law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in King County, Washington, and you hereby consent to personal jurisdiction in those courts.

Automated Content Moderation
Gratify uses automated keyword filtering and URL screening to detect content that violates our Terms of Service. This system scans creator names, bios, and linked URLs at the time of submission.
Flagged content is reviewed by our team within 24 hours. Creators found in violation may be suspended without notice. You can report violations using the Report button on any creator page. All reports are treated confidentially and reviewed by Gratify staff.

Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. For material changes, we will notify creators by email at least 14 days before the new terms take effect. Continued use of Gratify after the effective date of any revision constitutes your acceptance of the updated Terms.
